We maintain this web site as a service to our customers, and by using our site you are agreeing to comply with and be bound by the following terms of use. Please review the following terms and conditions carefully, and check them periodically for changes. If you do not agree to the terms and conditions, you should not review information or obtain goods, services or products from this site.

 

Definitions

 

 "Buyer" means the individual or organisation who buys or agrees to buy the Goods from the Seller;
 "Consumer" shall have the meaning ascribed in section 12 of the Unfair Contract Terms Act 1977;
 "Contract" means the contract between the Seller and the Buyer for the sale and purchase of Goods incorporating these Terms and Conditions;
 "Goods" means the articles that the Buyer agrees to buy from the Seller;
 "Terms and Conditions" means the terms and conditions of sale set out in this document and any special terms and conditions agreed in writing by the Seller.

 

Conditions

 

Nothing in these Terms and Conditions shall affect the Buyer's statutory rights as a consumer.
These Terms and Conditions shall apply to all contracts for the sale of Goods by the Seller to the Buyer and shall prevail over any other documentation or communication from the Buyer.

Acceptance of delivery of the Goods shall be deemed conclusive evidence of the Buyer's acceptance of these Terms and Conditions.

Any variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller. The Seller may choose not to accept an order for any reason.

 

Pricing & Availability

 

The Price of the Goods shall be that stipulated on the Seller's Website. The Price is inclusive of VAT. Delivery charges are itemised separately. All product prices are in £ sterling. We reserve the right to change any advertised price before accepting an order. 

We do our best to ensure that all information, descriptions, ingredients listings, photographs and prices of products appearing on the Site are correct at the time when the relevant information was entered onto the system. We aim to keep the Site as up to date as possible. All information is provided in good faith but the information including product descriptions, product sizes, product images and ingredients appearing on this Site may not always reflect the product exactly at the moment you place an order. 

We accept all orders for products subject to availability. If your order cannot be fulfilled you will be given a refund for the unavailable product(s).

The total purchase price, including VAT and delivery charges will be displayed in the Buyer's shopping basket prior to confirming the order.

 

After the order is received the Seller shall confirm by email the details, description and price for the Goods. If these differ from the details, description and/or price shown on the Website the Buyer shall be entitled to cancel the order.
 

Payment of the Price and delivery charges must be made in full before dispatch of the Goods.

 

Order Payment

 

Payment can be made using Visa, Visa Electron, Mastercard, Visa Debit and Maestro via Protx & LloydsTSB Cardnet. We also accept Paypal. Payment will be debited from your account before despatch of your purchase. All credit and debit card holders are subject to authorisation by the card issuer and if the issuer of your card refuses to pay us, we will not be liable for any delay or non-delivery. Just Beauty Direct also accept payment by cheque or postal order. Orders will not be dispatched until payment has cleared.

 

Order Delivery

 

All orders are shipped via tracked courier with proof of postage. A signature may be required. We aim to despatch your order within 48 hours of receipt. Dispatch means that your package will be sent by us within 48 hours NOT that you will receive it within 48 hours. Please see our shipping terms which form part of this agreement. If you have not received your product, within the time limit set for your product to be delivered, this may be due to a problem with the courier. If this is to happen, we will not be able to refund or resend the buyers product out until 30 working days has gone by since the product was sent. This is so the courier will have time to return the product back to Lumberjack, or for the product to be delivered. This can occur for many reasons, for example; Faulty address, Parcel not reclaimed, Lost in transit or a Stolen Parcel. After the 30 working days Lumberjack will then resend the buyers product with a tracking label. All parcels lost in transit or classed as a stolen parcel will be investigated by the courier.

The content, organisation, graphics, design, compilation, magnetic translation, digital conversion and other matters related to the Site are protected under applicable copyrights, trademarks, registered trademarks and other proprietary (including but not limited to intellectual property) rights. The copying, redistribution, use or publication by you of any such matters or any part of the Site, is strictly prohibited. You do not acquire ownership rights to any content, document or other materials viewed through the Site. The posting of information or materials on the Site does not constitute a waiver of any right in such information and materials.

 

Delivery

 

Goods supplied within the UK will normally be delivered within one to five days of receipt of order. Details of delivery costs and periods for delivery are explained in a separate delivery section.
Goods supplied outside the UK will normally be delivered within ten working days of receipt of order but delivery times will vary for different countries.

 

The Seller shall not be liable for any losses, costs, damages or expenses incurred by the Buyer or any third party arising directly or indirectly out of any failure to meet any estimated delivery date. Delivery of the Goods shall be made to the Buyer's address specified in the order and the Buyer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery. Title and risk in the Goods shall pass to the Buyer upon delivery of the Goods

 

Limitation of Liability

 

Except as may be implied by law where the Buyer is dealing as a Consumer, in the event of any breach of these Terms and Conditions by the Seller the remedies of the Buyer shall be limited to damages which shall in no circumstances exceed the Price of the Goods and the Seller shall under no circumstances be liable for any indirect, incidental or consequential loss or damage whatever. Nothing in these Terms and Conditions shall exclude or limit the liability of the Seller for death or personal injury resulting from the negligence of the Seller or that of the Seller's agents or employees.

 

Changes to Terms and Conditions

 

The Seller shall be entitled to change these Terms and Conditions at any time.

 

RETURNS POLICY

 

Return the item(s) within 7 working days beginning on the day after the day you receive the goods in a new and unused condition. If you do not, we may retain the items(s) and/or not refund at all.

 

The goods are your responsibility until they reach our warehouse. We recommend that you use a postal service that insures you for the value of the goods and allows you to track your parcel. The cost of returning the item/s to us is your responsibility and will not be reimbursed by Lumberjackbeards. Keep your certificate of the postage safe as you will need this as your proof of return. Refunds will be issued upon receipt and will take up to 10 working days to show back in your bank account.

 

In order to return an item you are required to write a Head Letter, specifying your Name, Contact Details, Reasons for the return and your Address. Failure to do so will result in a delay of up to 30 days in processing your return.

 

We will not make refunds to a third party.

 

Sale items are NON-REFUNDABLE.

 

EXCHANGE

 

If you choose to exchange an item you will be charged postage.
Sale items can be exchanged for a different size/colour in the same style.
As soon as we receive your returned goods we will process your request. Replacement goods held in stock will be dispatched within 7 working days. If your chosen substitute is not in stock we will contact you to offer either an alternative or a refund.


If your product is faulty, send it back to our return address, and a full quality check will be made from our quality control team. No found errors on the product will result in said customer having to pay for postage to return the goods back to them.

If an error has been made on Lumberjack's behalf, then return the product to our returns address, and a refund on your postage will be given.
